All prices displayed on this website are in New Zealand dollars.

Services and Conditions of Use
As part of our service, we agree to provide you with information and other services that we may decide to offer, subject to the terms of this agreement. Upon notice published through the service, we may modify this agreement at any time. You agree and continue to agree to use our services in a manner consistent with all applicable laws and regulations and in accordance with the terms and conditions set out in the policies and guidelines outlined below. Please note that you will be referred to as ‘customer’ in this agreement.

Rules For Online Conduct
By using the service, you agree that you will not attempt to undermine the integrity of this web site.

Limitation Of Liability And Warranty
Customer agrees that use of the service is entirely at customer’s own risk. Services are provided ‘as is,’ without warranty of any kind, either express or implied, including without limitation any warranty for information, services, uninterrupted access, or products provided through or in connection with the service, including without limitation the software licensed to the customer and the results obtained through the service. Specifically, we disclaim any and all warranties, including without limitation:
1) any warranties concerning the availability, accuracy or content of information, products or services; and 2) any warranties of title or warranties of merchantability or fitness for a particular purpose

The Sooteater is covered by a 12 month manufacturers warranty for parts only. It is not warranted for commercial use. The warranty is parts only and doesn't cover freight costs, faulty parts will need to be returned before a claim is approved.

This disclaimer of liability applies to any damages or injury caused by any failure of performance, error, omission, interruption, deletion, defect, delay in operation or transmission, computer virus, communication line failure, theft or destruction or unauthorized access to, alteration of, or use of record, whether for breach of contract, tortious behavior, negligence, or under any other cause of action. Customer specifically acknowledges the service is not liable for the defamatory, offensive or illegal conduct of other customers or third-parties and that the risk of injury from the foregoing rests entirely with customer.

Neither the service nor any of its agents, affiliates or content providers shall be liable for any direct, indirect, incidental, special or consequential damages arising out of use of the service or inability to gain access to or use the service or out of any breach of any warranty. Customer hereby acknowledges that the provisions of this section shall apply to all content on the service.

Backorders
If a product you order is temporarily out of stock, you may wish to place it on backorder. You will be advised of the expected dispatch date either by phone, email or mail and the product will be sent to you as soon as it becomes available. You will not be charged any additional delivery costs for backordered items delivered to you at a later date.

Outstanding Invoices
Any invoices outstanding for settlement will incur penalty interest at a rate of 2.5% will be applied each month until the account is settled. Any legal collection costs will be added to the outstanding account for collection.

Trademarks
All trademarks appearing on the service are trademarks of their respective owners.

Shipping & Returns

Shipping
All New Zealand orders are packed and despatched as soon as possible using trackable courier service. Nearly all rural delivery is handed over to the rural delivery drivers by the courier serve and this may take an extra day or two to get to you.

Shipping is available to North and South Island residential and rural addresses only. If you reside in an island in New Zealand, (e.g Great Barrier or Waiheke) extra charges may apply, or your item may be sent by NZ Post. We will contact you by the phone number you provide to discuss.

We take all care in adding delivery instruction to your order, however we have no control over the courier following these. Tracking numbers will be emailed to you after your product is packed by our despatch team.

Refunds
At Sooteater we understand that sometimes you might need to return an item because it’s not what you needed. If you change your mind about your purchase we are happy to give you a credit on your account for a future purchase. The credit has no time expiry so you can order when you next need something. The item must be returned in original undamaged packaging with all bags factory sealed. Shipping charges are not refundable and cost of shipping to return is to be paid by the purchaser.

Returns
Sooteater is committed to providing quality products, however if you are unsatisfied with your product you may return it in its original condition and packaging with your receipt with 14 days of purchase and we will credit that towards an alternate purchase (refer Refund policy). If during the normal use of your product you discover a manufacturing defect, please contact us at that time.
Manufacturers warranty applies on all Sooteater products, freight charges are excluded. Warranty applies to residential use only and excludes commercial use.

Collection of your personal information
The types of personal information that we collect from you will depend on how you use this web site and how you interact with us. For example, when purchasing products on line we collect details such as your name, delivery address and e-mail address.

When you use this website our Internet Service Provider (ISP) may make a record of your visit and log your server address, your domain name, the date, time and duration of your visit, the pages and documents you accessed, the previous site you had accessed (ie the referring URL) and the type of browser you are using. This information is collected for statistical purposes only, and Pratts Group will not make any attempt to identify users according to their browsing activity.
In the unlikely event of an investigation, a law enforcement agency or other government agency may exercise its legal authority to inspect our ISP’s logs.It is also possible that your ISP is logging your activity while you visit our site. This is obviously beyond the control of Pratts Group.

How we use and disclose personal information
The personal information that you provide to us during interaction on this site, and in other interactions between us, is used to provide you with better service for the supply of our products and services to you. The information we gather from your use of this web site enables us to provide more personalised products and services that are tailored to your needs. Sooteater NZ will not sell, rent or trade your personal information.
Any personal or business information which you do supply will only be used internally at Sooteater NZ and will not be divulged to a third party unless that third party is integral to the purpose for which you gave us the information (eg, delivery companies will be supplied with delivery information) or where required by law. We may use and disclose information about you for a purpose other than the purpose for which you gave us the information where:

You would reasonably expect us to use or disclose the personal information for that other purpose;
That other purpose is related to the purpose for which you gave us the information;

Sooteater NZ may also use your personal information for the purpose of direct marketing. We may only use your personal information or data for the purpose of direct marketing in relation to promotional activities where it is impracticable for us to obtain your prior express consent. However, when we do this, we will provide an express opportunity when we first contact you to decline receiving any further marketing communications from us, via an opt-out mechanism.
